As Colorado approaches significant changes in its housing regulations, particularly concerning Accessory Dwelling Units (ADUs), it’s essential for property owners and developers to understand the upcoming modifications.  Understanding Accessory Dwelling Units (ADUs)

ADUs, often referred to as casitas, in-law suites, or granny flats, are secondary housing units located on the same lot as a primary residence. They offer versatile solutions for various housing needs, including accommodating extended families, generating rental income, or providing affordable housing options in urban areas.

 Statewide Legislative Changes

In a move to address housing shortages and promote affordable living solutions, Colorado enacted House Bill 24-1152. This legislation mandates that, starting June 30, 2025, municipalities must permit the construction of at least one ADU on properties zoned for single-family detached dwellings. The law also prohibits local governments from enforcing regulations that unduly restrict ADU development. Key provisions include:

  • Size and Zoning Flexibility : Cities are required to allow ADUs ranging from 500 to 800 square feet on single-family properties, providing clear guidelines for homeowners.

  • Parking Requirements : The legislation restricts municipalities from imposing additional parking requirements for ADUs, removing a common barrier to their approval.

  • Homeowners Association (HOA) Regulations : HOAs can no longer enforce covenants that outright ban or unreasonably restrict the construction of ADUs, ensuring more uniform adoption across communities.

 Implications for Colorado Springs

In response to the state mandate, Colorado Springs is updating its local ordinances to align with the new ADU regulations. The city’s proposed ordinance aims to:

  • Expand ADU Permissibility : Allow ADUs in all zoning districts where single-family detached homes are permitted, broadening opportunities for homeowners.

  • Revise Use Standards : Update specific standards for ADUs to ensure they integrate seamlessly into existing neighborhoods while maintaining community character.
  • Eliminate Permanent Owner-Occupancy Requirements : Remove mandates that the primary residence be owner-occupied after construction, offering more flexibility for property owners.

These changes are designed to diversify housing options, promote smart growth, and address the city’s increased housing demands. However, as with any regulatory update, it’s crucial to stay informed about the final provisions once adopted.
